Doctors Council SEIU Unfair Labor Practice Charges Against Mount Sinai and PAGNY

(NEW YORK) -  In support of attending physicians in New York City, Doctors Council SEIU, the nation’s largest doctors’ union, has filed two unfair labor practice charges with the National Labor Relations Board (NLRB) against Health + Hospital affiliates Mount Sinai and PAGNY.

The charges against Mount Sinai cite its refusal to provide requested information and to bargain over a key component of doctors’ wages—one of the most fundamental subjects of bargaining. The charge against PAGNY challenges  its refusal to negotiate over the compensation of per diem doctors. Doctors Council represents full-time, part-time, and per diem doctors at PAGNY healthcare facilities, yet PAGNY refuses to include per diem doctors in negotiations or discuss their compensation with the union. By unilaterally determining per diem doctors’ pay without bargaining, PAGNY is undermining the union and silencing per diem doctors’ voices—actions that clearly violate federal labor law.

“The city has shown they have zero interest in recruiting and retaining doctors in the H+H public health system. Their failure to bargain in good faith shows their lack of respect for our members and these negotiations, which is why we filed Unfair Labor Practice charges against both employers Mt. Sinai and PAGNY. At our rallies we chant, "recruit, retain, and respect." We demand both that PAGNY and Mt. Sinai adhere to those same principles,” Dr. Frances Quee, Pediatrician and President of Doctors Council, SEIU.

Despite publicly stating their commitment to protect patients and value the workforce, Mount Sinai and PAGNY have violated federal law by undermining negotiations for better working conditions while simultaneously making unilateral decisions that directly impact patient care.

Doctors Council urges Mount Sinai and PAGNY to immediately cease retaliating against workers and instead partner with public health physicians to address the medical workforce shortage that continues to endanger and shortchange New York’s most vulnerable communities.
